City Council Notes - May 6

Public Hearings

4.1 City of Cranbrook Official Community Plan Amendment Bylaw No. 3751,2013

4.2 City of Cranbrook Zoning Amendment Bylaw No. 3766, 2013

4.3 City of Cranbrook Zoning Amendment Bylaw No. 3769, 2013 (Shipping Containers)

There were 6 submissions made by local business owners who expressed concerns including setbacks, the limits to the number of sea cans per lot, and how important the sea cans are for local businesses for storage. There was a feeling from the business owners that more time was needed for further consultation. Council agreed and decided not to proceed with the third reading until this consultation has taken place which might lead to some modifications in the Bylaw.


Delegations

5.1 Arts Council - Presentation made by several Arts Council board members re: upcoming fundraising in their all out effort to create a permanent home for the Arts Council 
5.2 RCMP Mayor's Report - 61% increase in mischief. Traffic violations will be a priority

7.1 Administration Updates

Engineering
Chip Seal Treatments - Suitability for resurfacing 29th Ave. S.
Relatively low cost alternative pavement solution to hot mix asphalt paving under certain conditions. This treatment is ideally suited to 29th Ave. S (as well as 27th Ave. S.) Unfortunately there are no contractors in Cranbrook who provide this type of paving.

2013 Road Program
Phase 3 work on 14th Ave. S. has been tendered and construction start planned for mid June.

Canada Day Costs
Staff have determined that the costs for a basic Canada Day celebration will cost $12150

Canada Day costs are $7000 over the money the City has for the event. Council agreed that perhaps a spared down Canada Day celebration was something the City should consider. The event could possibly be something like an event in Rotary Park with live entertainment and cake but no fireworks.

9.1 Town Hall Challenge - National challenge to demonstrate  your municipalities commitment to climate protection

9.2 Jumbo Judicial Review - Letter from City of Nelson and their resolution that UCBM be encouraged to submit an application to the Supreme Court of BC seeking intervention status in the case between the EcoSociety and the Province of BC and Jumbo Glacier Mountain Resort Municipality.

9.5 Go Cart Track - Letter from Maxine Adshead opposing the Go Cart facility at Western Financial Place

Proponent for the Go Cart Trak has withdrawn his application as he has found another sight that might be better that the WFP parking lot

9.6 Go Cart Track - Mountain Meadows Strata writing to express concern about the proposed Go Cart Venue at Western Financial Place.

Proponent has withdrawn his application.

9.7 Solar Hot Water for Pool - Letter asking City of Cranbrook to reconsider solar hot water for the local pool.

9.8 BC Transit Workshop - Held in Whistler between May 27-29

Councillor Denise Pallesen will attend the workshop.

9.9 Brick Building behind City Hall - Proposal to repair and preserve the brick building behind City Hall.

The City had already made the decision to not spend any tax payer dollars on this building. 
There has been an engineering report done which indicated that the cost of just stabilizing the building would be over $130,000. The proposal to repair and preserve the brick building indicated that it could be done for $30,000. Councillor Whetham suggested the the proponents be shown a copy of the engineering study to give them a complete picture of what needs to be repaired. Councillor Gerry Warner made an impassioned plea for preservation. A motion was put forward to delay the destruction of the building until June 21 for the group to come forward to make a presentation to the City Council.
Councillors Scott, Pallesen, and Davis voted against the motion.
Councillors Cross, Whetham, Warner and Mayor Stetski voted in favor.

9.10 2013 Provincial Election Platform

9.11 4 Way Stop Request - Location would be one block up from the Post Office

Will be forwarded to Cranbrook in Motion Committee.

9.12 Rotary Fun Request - June 1 Fundraiser - Carried

9.13 Proclamation - National Missing Children's Day - Approved

9.14 Proclamation - World Red Cross Day - Approved.

Committee Recommendations

11.1 Family and Community Service Committee Recommendations

11.2 Sustainable Community Builder Award Committee Recommendations - That Council approved Cranbrook Health Auxiliary as recipient of the Sustainability Community Builder of the Year Award.

New Business

12.1 Liquor Licensing Boston Pizza - permanent change to its Food Primary Licence to change the hours of sales from 11am to Midnight (M,T,W,&T) and 11am to 1am Friday and Sat.

12.2 Asia Pacific Delegation - To seek a resolution of Council authorizing delegation trip to Wonju and Taicang scheduled for June 2013.

Councillor Diana J. Scott was selected to attend with Mayor Stetski. 
This did generate some discussion regarding the extra expense to send  a councillor when the Mayor is also going. The entire budget for this program has been spend and the additional funds to send a councillor will have to be found elsewhere.
Councillor Cross did add that given the City did not have enough money to put on a full Canada Day celebrations sending a councillor was not fiscally responsible.
Councillors Cross and Whetham, citing financial considerations, voted against sending a councillor to Wonju and Taicang. 

12.3 Famers Market Street Closures - To request Council's approval of street closure on 10th Ave. S. for the purpose of accommodating the Farmer's Market on Saturdays during the summer months.

12.4 Off Line Storm Water Detention Facility - To seek approval to  proceed with appropriate engineering studies for use of city owned property on Kootenay Street.

$50,000 approved for engineering feasibility study

12.5 Mad Max's Go Cart Proposal - To consider the proposal presented by Mad Max's Go Karts regarding leasing a portion of the Western Financial Place parking lot for a go-carting business.

Bylaws

13.1 Draft Sign Bylaw Comments
There were 27 completed questionnaires. 22 agreed with the draft sign bylaw regulations and 21 agreed with the draft sign bylaw design guidelines. 5 disagreed with the draft sign bylaw regulations and 4 disagreed with draft sign design guidelines. 2 of the 5 who disagreed with the draft sign bylaw regulations did not support electric signs.

Both Councillor Scott and Pallesen requested more time to review the questionnaires and the revised Bylaws. Given the lateness of the evening and the amount of discussion that this Bylaw would require a motion to postpone and to call a special Council meeting was approved.
